Terms & Conditions

These Terms govern your relationship with the operator of the website available at https://fairgowin-au.com (the "Site") and your use of the gambling services offered through it. By accessing or using the Site, you agree to be bound by these Terms as updated from time to time. These Terms are effective as of 1 January 2026.

Definitions

In these Terms, unless the context otherwise requires:

  • "Brand" or "Fairgo" means the online gambling brand promoted via the Site in connection with Fairgo.
  • "Operator" means Deckmedia N.V. or any affiliated entity operating and providing gambling services under licence 365/JAZ issued by Gaming Curacao, as applicable, in connection with the Site.
  • "You", "User" or "Player" means any natural person who accesses the Site, registers an account, places a Bet or otherwise uses the services.
  • "Account" means the personal player account opened by you with the Operator through the Site.
  • "Services" means all gambling, betting, gaming, promotional and ancillary services made available on or through the Site.
  • "Game(s)" means any online casino, slots, table games, video poker, live dealer or other interactive gambling product offered on the Site.
  • "Bet" or "Wager" means any amount of real money or Bonus funds staked by you on the outcome of a Game.
  • "Bonus" means any promotional credit, free spins, cashback, free bet or other incentive granted by the Operator that is not directly deposited by you.
  • "Bonus Funds" means the value of any Bonus, including winnings derived from a Bonus, that is subject to wagering requirements or other conditions.
  • "Real Money Balance" means the portion of your Account balance consisting of funds you have deposited and any winnings that are no longer subject to wagering requirements.
  • "Wagering Requirements" means the total value of qualifying Bets that must be placed before Bonus Funds or associated winnings can be withdrawn.

Account Registration

Eligibility and legal restrictions

  • Age requirement: You may only open an Account and use the Services if you are at least 18 years old or the minimum legal age for online gambling in your jurisdiction, whichever is higher. The Operator may request proof of age at any time and suspend or close Accounts where age cannot be verified.
  • Jurisdictional restrictions: The Operator's Services are licensed in Curacao and are not authorised by Australian regulators. Under the Interactive Gambling Act 2001 (Cth), it is generally unlawful for offshore operators to provide certain interactive gambling services to persons in Australia. The Site and Services are not targeted to, and must not be used by, persons located in Australia or any other Prohibited Jurisdiction. Registration process

  • Creating an Account: To register, you must complete the online form on the Site, providing at least your full name, date of birth, email address, chosen username and password, and any additional information requested.   • Failure to verify: If you do not complete KYC to the Operator's reasonable satisfaction, the Operator may suspend or close your Account and withhold access to the Services and/or funds subject to applicable law and anti-money laundering (AML) obligations.

User obligations and security

  • Accuracy of data: You must keep your registration details updated and accurate at all times. You must promptly notify the Operator via [email protected] of any changes (e.g. name, address, email). The Operator is not responsible for losses arising from outdated or incorrect information you provide.
  • Password and access security: You must keep your username, password and any other security credentials strictly confidential and not share them with any third party. All activity on your Account, whether or not authorised by you, will be deemed to have been carried out by you until you notify the Operator of suspected compromise.
  • Prohibited account use: You must not:
    • open an Account on behalf of another person or as a proxy;
    • allow any other person to use your Account;
    • use the Services for commercial, professional, automated or arbitrage purposes; or
    • use the Services in breach of any applicable law or regulation, including local gambling, AML and counter-terrorism financing laws.
  • Account review: The Operator reserves the right to review, audit or investigate any Account at any time for compliance, fraud prevention and AML purposes and may request additional information or documentation as reasonably required.

Betting & Gameplay Rules

Placing Bets

  • Funding requirement: You may place Bets only from your available Real Money Balance or Bonus Funds, as applicable. Bets attempted in excess of your available balance will not be accepted.
  • Minimum and maximum stakes: Each Game has specific minimum and maximum betting limits displayed within the Game interface. It is your responsibility to review these limits before placing a Bet. The Operator may apply overall daily, weekly or monthly betting limits or impose personal limits when required by law or for risk management.
  • Bet acceptance: A Bet is deemed accepted once it is recorded on the Operator's servers and reflected in your Account transaction history. In the event of any discrepancy between your on-screen balance and the Operator's system records, the Operator's records will prevail, subject to manifest error.
  • Automatic play features: Where Games offer "autoplay" or similar features, you remain fully responsible for all Bets placed using such features until the feature is stopped or the relevant limit is reached.

Modification and cancellation of Bets

  • Irreversibility: Once placed and accepted by the Operator, Bets cannot normally be cancelled, withdrawn or amended by you.
  • Operator corrections: The Operator may void or adjust Bets where:
    • a technical or human error resulted in incorrect odds, Game behaviour or payout calculation;
    • the Bet was placed after the outcome of the relevant Game or event was known or should reasonably have been known;
    • there is evidence of fraud, collusion, use of bots or other prohibited conduct; or
    • regulatory or legal obligations require voiding or refunding of Bets.
  • Refunds on errors: Where a Bet is voided due to an Operator or system error, your stake will normally be returned to your Real Money Balance. Bonus-related stakes will be restored as Bonus Funds where applicable.

Game rules and results

  • Game-specific rules: Each Game is governed by its own rules, paytables and instructions displayed within the Game interface. By playing a Game you agree to be bound by those rules in addition to these Terms.
  • Random Number Generator (RNG): Electronic Game outcomes are determined by an RNG system operated or approved by the Operator. The RNG is designed to ensure fair and random outcomes. You acknowledge that results generated by the RNG are final and binding, subject to investigation of any technical error.
  • Result determination: The definitive result of a Game is as recorded on the Operator's servers. In case of disagreement between the result displayed on your device and the Operator's records, the Operator's records will prevail, save for manifest error.

Conduct in live casino, chats and interactions

  • Respectful behaviour: When using live casino tables, chat functions or any interactive features, you must behave respectfully towards dealers, other players and staff. The following is strictly prohibited:
    • insults, harassment, hate speech, threats or abusive language;
    • obscene, defamatory, racist, sexist or otherwise offensive content;
    • advertising of other sites or services, spamming or solicitation; and
    • sharing personal data of others without their consent.
  • Prohibition of fraud and unfair play: You must not engage in any fraudulent, deceptive, collusive or otherwise unfair conduct, including but not limited to:
    • using bots, scripts, automated systems or AI agents to play or make decisions;
    • colluding with other players to gain an unfair advantage;
    • exploiting software bugs, loopholes or obvious errors in Games or Bonuses;
    • using stolen or unauthorised payment methods; or
    • engaging in money laundering or any activity that may breach AML or counter-terrorism financing laws.
  • Consequences of misconduct: The Operator may, at its sole discretion and subject to applicable law, remove chat privileges, void Bets, confiscate Bonuses, suspend or close Accounts, and notify relevant authorities where serious misconduct, fraud or illegal activity is detected.

Bonus Terms

General bonus conditions

  • Separate terms: All Bonuses and promotions are subject to these Terms and any specific rules or conditions published on the Site for the relevant offer. In case of conflict, the specific promotion terms will prevail to the extent of the inconsistency.
  • Eligibility: Bonuses may be limited to particular Users, regions, payment methods or time periods. The Operator may grant or withhold Bonuses at its sole discretion, provided that any Offers already accepted and not yet used will be honoured in accordance with their terms and applicable law.
  • Bonus credits: Bonuses will be credited to your Account as Bonus Funds or free spins once all activation conditions are met (for example, successful deposit with a valid bonus code). You are responsible for checking that a Bonus has been correctly applied before placing Bets.

Activation and wagering requirements

  • Activation criteria: Common activation conditions may include:
    • making a qualifying deposit of at least the stated minimum amount;
    • entering a valid bonus code during deposit or in the cashier; and
    • not having an existing active Bonus at the time of claiming a new Bonus.
  • Wagering Requirements: Unless stated otherwise, Bonuses and related winnings must be wagered a specified number of times (e.g. 30x the Bonus amount, 30x the deposit plus Bonus, or other clearly stated multiplier) before they can be transferred to your Real Money Balance or withdrawn.
  • Timeframes: Each Bonus may have a fixed validity period (for example, 7 - 30 days) during which Wagering Requirements must be met. At the expiry of this period, any remaining Bonus Funds and associated winnings may be forfeited. You should check the specific timeframe for each Bonus.
  • Contribution of Games: Different Games may contribute differently towards Wagering Requirements (e.g. slots 100%, table games 10%, some Games 0%). The applicable contribution rates will be set out in the Bonus terms on the Site. Bets on Games with 0% contribution will not count towards Wagering Requirements.

Betting restrictions with active Bonuses

  • Maximum Bet rules: When an active Bonus is in play, there may be a maximum allowed Bet per spin or game round (for example, a fixed dollar amount or percentage of the Bonus value). Exceeding these limits may result in forfeiture of the Bonus and any related winnings, subject to applicable law and the principles of fairness.
  • Prohibited strategies: The following practices are typically prohibited while wagering a Bonus:
    • placing low-risk or equal-odds Bets solely to meet Wagering Requirements;
    • placing single large Bets that are disproportionate to the Bonus size;
    • delaying or hoarding bonus-triggered features (e.g. free spins or bonus rounds) to a later time after wagering requirements are met; and
    • using multiple Accounts or coordinating with other players to abuse a promotion.

Prohibited actions and combining promotions

  • Bonus abuse: If the Operator reasonably believes that you have abused a Bonus or promotion, it may cancel the Bonus, adjust your balance, void associated winnings and/or close or restrict your Account, subject to applicable consumer protection and gambling laws.
  • Combining offers: Unless explicitly stated otherwise, only one Bonus or promotion may be active on your Account at a time. You may not:
    • combine multiple welcome or deposit Bonuses in a single transaction; or
    • use free spins or free bets from one offer to meet Wagering Requirements of another offer.
  • Cashback and loyalty programmes: Cashback, loyalty points and VIP rewards may be subject to separate rules regarding earning, redemption and expiry, which will be made available on the Site.

Payments & Withdrawals

Deposits

  • Payment methods: The Site may support a range of deposit methods, which can include:
    • credit and debit cards;
    • e-wallets and online payment services;

Withdrawals

  • Chargebacks: If you initiate a chargeback, reversal or dispute of a payment, the Operator may:
    • suspend or close your Account;
    • void any pending Bets or Bonuses; and
    • recover any winnings already paid out that are connected to the disputed funds.
  • Negative balances: If your Account shows a negative balance due to reversal of transactions, chargebacks or corrections of errors, you must deposit sufficient funds to clear the negative balance. The Operator may offset the negative balance against future deposits or winnings.

Limitation of Liability

Operator's obligations

  • Fairness and integrity: The Operator will use reasonable efforts to ensure that:
    • Games operate fairly and in accordance with their stated rules and technical specifications;
    • RNG-based Games produce random results consistent with the intended design; and
    • the Services are provided with reasonable skill and care, consistent with industry standards and the Operator's licensing obligations in Curacao.
  • Accuracy of results and balances: The Operator will take reasonable steps to ensure that Game outcomes, account balances and transaction records are recorded accurately. In the event of an error, the Operator will correct the error and, where appropriate, restore your Account to the position it would have been in had the error not occurred.

Exclusions and limitations

  • No guarantee of uninterrupted service: The Services are provided on an "as is" and "as available" basis. The Operator does not guarantee that access to the Site or Games will be uninterrupted, error-free or free from viruses or other harmful components.
  • Technical failures and external factors: The Operator is not liable for:
    • any loss or damage caused by failures of telecommunications, internet connectivity, hardware, software or third-party systems;
    • incomplete, lost or delayed data transmissions; or
    • your inability to access the Services due to maintenance, downtime or updates.
  • Maximum liability: To the maximum extent permitted by applicable law, the Operator's total aggregate liability to you for any claim arising out of or in connection with your use of the Services (whether in contract, tort, negligence or otherwise) will not exceed:
    • the amount of the Bet in dispute; or
    • where no specific Bet is in dispute, the lesser of (i) your net deposits to your Account in the three (3) months preceding the incident, and (ii) AUD 5,000 or equivalent.
  • Exclusion of indirect damages: To the fullest extent permitted by law, the Operator will not be liable for any indirect, incidental, consequential or punitive damages, including loss of profits, loss of data, loss of opportunity or business interruption.
  • Consumer rights: Nothing in these Terms excludes or limits any statutory rights or remedies that cannot be excluded or limited under applicable consumer protection laws. To the extent Australian consumer laws apply notwithstanding the Operator's offshore status, any limitations of liability will be interpreted consistently with those laws.

Intellectual Property Rights

Ownership of content and software

  • Proprietary rights: All intellectual property rights in and to the Site and Services, including but not limited to the software, source code, algorithms, databases, design, graphics, trademarks, trade names, logos, text, audio-visual content and other materials, are owned by the Operator, its licensors or other third-party rights holders.

Termination & Suspension

Operator's rights

    • there is suspicion of fraud, money laundering, collusion or other illegal or abusive activity;

    • required by law, regulation, court order or at the request of a competent authority.
  • Account review upon termination: Upon suspension or closure, the Operator will review your Account balance. Subject to its rights under these Terms and applicable law (including AML and confiscation obligations), the Operator will generally:
    • return any undisputed Real Money Balance to you; and
    • void or forfeit Bonus Funds and associated winnings.

Your rights

  • Voluntary closure: You may request closure of your Account at any time by contacting customer support at [email protected]. Before closing, the Operator may:
    • request that you withdraw any remaining Real Money Balance; and
    • complete outstanding verification checks.

Effect of termination
